Want to see what the response will be to this proposal.

The Legislative shall not have the authority to exempt themselves from any laws or regulations they have or will enact.

Believe it should go in Article III, probably a new section.

I'm certainly down with that ...

Wait, before we do that we need to include exempting any companies, affiliates, lobbyists, and other agencies of government. Local or national.

You did see the federal version of this right? So now we cannot sue the telecom or internet providers for framing and extorting us, ignoring our constitutional rights of probable cause. This also means anyone who resites the constitution on the internet can be considered a terrorist, and sent to execution without trial, or warrant and treated like the "suspects" at Gitmo?

As a matter of fact, this entire website is a complete violation of what is considered terrorism, apparently this is what happens when you don't pay enough attention to what our government is doing.

Want proof? check this FBI handout about terrorists. http://www.radioliberty.com/fbipam.htm

It makes you think twice about the whole "war on terror", just remember its the first war for the US that didn't get a declaration of war, why, because who is terror? Its you!

Correction to cashpoor:

The Iraq war is absolutely not the first time the U. S. has gone to war without a declaration of war. The last declaration of war came in 1945, against Germany, Japan, and Italy. Since then we have fought wars or staged invasions in Korea, Vietnam, Laos, the Dominican Republic, Haiti, Panama, Grenada, and of course Iraq. (That's not including coups and assassinations, which is a whole different ballgame.)

To Kaunaloa:

Probable cause?

We're a bit off the track of a ConCon discussion here, but I'll add this: according to George Bush's interpretation of the U. S. Constitution, he is entitled to arrest Peter, you, me, or anyone else in the country, designate that person a terrorist, and hold her or him as long as he wants to, on no evidence but his own say-so, and being accountable to nobody. He's not likely to do so, but if he wanted to, he thinks he can. And he's done it with at least two people that we know of.

Re the original question:

I think this is a very reasonable approach.

Good idea. Law is law. Of course penalty may double because of the community trust they hold.

The July 3, 2008 issue of the Maui Weekly included a half page by Governor Linda Lingle on page 15 with the headline "A Con Con Would be Beneficial for the Entire State". She noted that "In 1996 Hawai'i voters cast more "yes" than "no" votes in support of a con con. However, that year the Hawai'i Supreme Court ruled that blank ballots be counted as "no" votes. Consequently, a con con hasn't been held in our state since 1978."
She also stated that Lt. Gov. Aiona is heading a committee studying the costs of a con con, that a report will be made by Aug 1 2008, and that "Residents can provide their comments to the task force at concon@hawaii.gov"

Sorry it took me so long to reply. It's been a long time, and I've forgotten the details, including the name of one of the men. The other is named Hamdi (can't recall first name). A U. S. citizen, he was arrested at the Detroit airport and described as a terrorist who planned to detonate a "dirty bomb." He was held incommunicado for several years, never seeing anyone but his guards and interrogators. The country was told he was a vicious terrorist, etc. After the courts eventually told the government they had to at least explain to a court why they were holding him, the government decided to accuse him of sending funds to Al Qaeda or some such minor offense -- the dirty bomb charge vanished. They still insisted he be held without charge indefinitely, and as far as I know he still is. I believe he is allowed to see a lawyer now, but only in the presence of his captors.

This is not American justice.

um, if this is the hamdi u are talking about, yer story doesn't quite add up -- "Yaser Esam Hamdi (b. September 26, 1980) is a former American citizen who was **captured in Afghanistan** in 2001."
